Apparently Jimmy Hughes has always felt so well protected that he could confess to murders and believed he would never have to pay the penalty. For twenty-eight years he was absolutely correct in his beliefs. It began one quiet night in the desert just outside of Indio, California.

On a summer night on June 29, 1981 three friends relaxed is the backyard of a small stucco home at 35-040 Bob Hope Drive in a desert town appropriately named Rancho Mirage. The three friends sat is a semi-circle, the two men in wooden chairs and the woman on a single bed that served as a lounge chair. They were sharing drinks and stories. The big man was a 32-year-old Indian, a member of the Cabazon tribe whose 1700 acre reservation adjoined the nearby town of Indio, California. His friend was a slightly built white man ten years his senior. The woman had been an acquaintance of both two men and was intently following their conversation.

(Suddenly the peaceful scene was shattered. Three shots rang out. Three friends lay dead.

In the California Daily News on July 2, 1981 staff reporter Paul Zalis reported The three bodies found in an apparent execution-style slaying Wednesday have been identified as Alfred “Fred” Alvarez, 32, Patricia Roberta Castro, 44, of Long Beach and Ralph Arthur Boger, 42, of San Bernardino.

The family of Fred Alvarez had always believed that the head of Cabazon Tribal Security Jimmy Hughes had been involved in the killings. Hughes worked for and reported to “Dr.” John Phillip Nichols, the white manager of the Cabazon Tribe. Yesterday, at the International Airport in Miami, Florida Jimmy Hughes was arrested and detained on a sealed warrant from California charging the 52-year-old man with three counts of murder and one count of conspiracy to commit murder.

Approximately one month ago the California Deputy Attorney General Michael Thomas Murphy, based in San Diego, issued an arrest warrant for Hughes under seal. Riverside County Deputy Sheriff John M. Powers then notified United States Customs to be on the lookout for Hughes who lives in Honduras. About two weeks ago Hughes came back to the U.S. unnoticed by Customs. However, when the wanted man made a reservation on American Airlines to return to Honduras the” red flag request” from California was picked up by Customs who alerted Deputy Sheriff Powers. Powers is the cold case detective who had dedicated almost two years of his life investigating the Alvarez executions.

Powers booked a flight out of Ontario, California to Miami, Florida at 11:00 pm Friday night. Powers said, “Customs and Dade County Sheriff's assisted me and we escorted Jimmy off the plane just minutes before the scheduled departure. He was booked into the Dade County Jail on 12th street (near the airport).” Jimmy Hughes is held as prisoner number 090082914 according to Officer T. Thompson at the pre-trial detention center. Booking has misspelled Hughes last name as “Hoghes” but his date of birth is correctly noted This reporter has been told that Jimmy Hughes is being represented by an attorney in Miami. Tomorrow Deputy Sheriff Powers and suspect Jimmy Hughes will appear in the Dade County Superior Court. It is believed that Mr. Hughes intends to waive extradition to California. If all goes as anticipated Deputy Sheriff John Powers will return to Riverside, California with suspect Jimmy Hughes on Monday, September 28, 2009.

After 28 years of freedom, will Jimmy Hughes finally be held accountable for the killings he has detailed on the World Wide Web?

Detective John Powers will return to California alone today. Multiple murder suspect Jimmy Hughes has taken the advice of his Miami based attorney Rene A. Sotorrio and will not waive extradition in Case No. F-09-031832, Miami-Dade County, 11th Judicial Circuit Court.

The burden now shifts to California State Deputy Attorney General Michael Thomas Murphy to draw up the extradition papers and obtain Governor Arnold Schwarzenegger’s signature on a formal demand for extradition accompanied by supporting documents. This demand will be submitted to the Governor of Florida Charlies Crist who will review the demand, and if he finds it valid, may issue his Governor's warrant of arrest.

The warrant will be executed and the papers will be submitted to the Miami-Dade County 11th Judicial Circuit Court. Hughes will then be arraigned in court on the warrant and may challenge its validity by a writ of habeas corpus and may seek bail. Whether or not Hughes will be returned to California to face charges on suspicion of committing and conspiring to commit the murders of of Alfred "Fred" Alvarez. Patricia Roberta Castro, 44, of Long Beach and Ralph Arthur Boger that took place twenty-eight years ago, may depend upon the judge's ruling on any such habeas corpus petition.

Meanwhile Hughes remains in jail held on an "out of state warrant".

Police link self-dubbed hitman Hughes to triple homicide in Rancho Mirage

The Riverside County Sheriff's Department has identified a suspect in the 1981 unsolved murders of three Coachella Valley residents.

James “Jimmy” Hughes, 52, was arrested at the Miami International Airport on Saturday on a fugitive warrant related to three California murders, Miami-Dade law enforcement officials said Monday.

A self-described ex-mafia hit man, evangelist and president of Jimmy Hughes Ministries, Hughes has traveled throughout Honduras and the United States “taking the Gospel of Jesus Christ,” according to his Web site.

He faces an extradition hearing in Miami today that he is fighting, Riverside County sheriff's Sgt. Dennis Gutierrez said.

It is unclear how long the extradition process with Florida could take.

At the time of his arrest, Hughes was headed to Honduras, Gutierrez said Monday evening.

“I'm not going to be able to tell you who's bringing him in until he hits our jail,” Gutierrez said.

Phone numbers for Hughes' Miami-based ministry were out of service Monday.

Hughes was arrested on suspicion of being involved in “the Octopus murders” — the 1981 slayings of former Cabazon tribal leader Fred Alvarez, 32, Patty Castro, 44, and Ralph Boger, 42, Gutierrez said.

The California attorney general is prosecuting the case because of a conflict of interest with Riverside County District Attorney Rod Pacheco, said Dana Simas, a spokeswoman for the attorney general.

The state assumed responsibility for prosecuting the case earlier this year, said Sue Steding, Riverside County chief assistant district attorney.

“Jimmy Hughes is a distant relative of our district attorney,” Steding said. “The district attorney has not seen this distant relative in over a decade.

“We have every confidence that the attorney general will pursue this case with vigor.”

According to press accounts at the time of the murders, the bodies were found unbound, fully clothed with a single shot to the head with a .38-caliber gun “at different angles.”

The coroner was unable to conduct drug screen tests because of the decomposition of the bodies, which were found on the patio of a small house Alvarez rented on Bob Hope Drive in Rancho Mirage.

“Having three people shot in the head would be very unusual without at least one of them shot in the back trying to escape,” Deputy Coroner Robert Drake told The Desert Sun days after the June 29 murders.

“Either they were out, intoxicated or there was more than one person involved.”

Internal problems among members of the Cabazon Band of Mission Indians at the time led to widespread speculation of a link between the murders and the tribe, which tribal members have long disputed.

Tribal Chairman David Roosevelt did not immediately respond to a phone call Monday.

Investigators at the time said they suspected it would take some time to crack the case.

Rachel Bagley, Boger's daughter, said Monday she never imagined it would take so long to arrest a suspect.

“I was 13 and I thought my dad was like Superman,” said Bagley, who lives in Kentucky.
As I remember it this whole thing factors into the Michael Riconosciuto, Danny Casolaro and Wackenhut affairs.

Interestingly, the LA Times story reports Hughes stating that the murders in question had a political dimension:

This suggests to me that Hughes own days may now be numbered.

Self-described Mafia hit-man James “Jimmy” Hughes, 52, was arrested on September 26 as he boarded a plane at Miami-Dade International Airport heading for Honduras. The fugitive warrant lists three counts of murder and conspiracy to commit a crime for the 1981 execution-style murder of Cabazon Tribal Council Vice-Chairman Fred Alvarez, his friend Ralph Boger, and Patricia Castro in Rancho Mirage, California.
Detective John Powers at the Riverside County Sheriff’s Department in California, Central Homicide Unit – Cold Case Division, was assigned to investigate the 28-year-old triple homicide case about 2 years ago when Rachel Begley, the daughter of victim Ralph Boger, convinced the sheriff’s department to re-open the case.
Both Powers and Begley were aware of what they were stepping into when they launched their investigations. Today, their respective findings include information relating to Jimmy Hughes’ political and military connections in Honduras, as well as his political ties to the republican politicians in the US.

Hughes has been held at Miami-Dade Metro West Detention Center since his arrest on 09/26/09. The extradition process involves a Governors Warrant being sent from the State of California to the office of Charlie Crist, Governor of Florida. During the time that the paperwork is being completed, Hughes is required to have a hearing approximately every 30 days. The State of Florida can hold Hughes up to 90 days while the paperwork is being completed, after which time, they reportedly must release him.
Today, for the second time, the hearing scheduled for Jimmy Hughes has been delayed. The hearing today was to take place before Judge Bertila Soto at 9:00am Eastern Time. Monica Torline, reporter for The Desert Sun confirmed today through both the County Clerks Office and the Miami Dade County State Attorney’s Office that the hearing has been moved a second time, this time being held on November 20, 2009.

Upon learning the news of the second delay, Rachel Begley decided to take action to find the reason for the delay. During the course of the day, she was able to confirm that Governor Charlie Crist’s Office has had the completed paperwork in their possession for over two weeks. She made multiple calls, left multiple voice mails, sent emails, and faxes to attempt to speed up the extradition of Jimmy Hughes.
After being transferred she was able to speak with multiple individuals in the legal department at the Governor’s Office. Rachel was informed by Kerry Owens that only one person is in charge of the extradition, Susan Smith, Florida State Extradition Coordinator. In attempting to speak with Susan Smith, Rachel was informed by a Heidi, within the legal department, that Susan Smith was not in court today due to her being at a conference. Rachel asked to speak with Susan Smith’s supervisor and was told by Heidi that her immediate supervisor is Charlie Crist and that nobody is allowed to speak with him nor leave him a voice mail.
Monica Torline of The Desert Sun wrote today, “Once we issue the warrant we are not involved in the extradition process as it moves through the court system,” Florida press secretary Sterling Ivey told The Desert Sun by e-mail Friday. Officials in the extradition unit of the Miami Dade County State Attorney’s Office said in most cases, the governor’s warrant is filed with the court during an extradition hearing.”

This extradition hearing has yet to take place. One must wonder how long the delays and stalling will take place? Will Jimmy Hughes be released due to the State of Florida’s stalling techniques or a technicality?
