But there's a lot to be learned from this obviously desperate attempt to discredit the ongoing unofficial investigation of the Century 16 massacre. It infers that the victims are all "government actors" and prostitutes and claims the police chief and lead prosecutor blackmailed a victim into perjuring himself then shot him at his home. Key to this fraud is the fact that it names Phillip Anschutz as being behind all of this and that is clearly designed to discredit various unofficial investigations which have come to a similar conclusion. Aside from looking at how it was written and who it actually serves, the fact is, the judge should never have released it in the first place since pretending to be a victim and sending in a false statement to a court is a crime in itself. The letter is key evidence in a felony and announcing to it's creator that the court is now looking for him gives him a certain advantage to escape detection that any judge in his right mind would never do. Releasing that document and the judge's subsequent finding is highly unusual and hinders the investigation while serving only to openly discredit that GROWING majority of people in the country who find SERIOUS problems with 1. the official story of the Aurora Massacre and 2. the increasingly disturbing manner in which the prosecution of James Holmes is being handled. Philip Anschutz and his various business dealings have come under a certain amount of scrutiny since the unofficial investigation of the Aurora Massacre took off following the July 20th attacks. Turns out not only were most (if not all) of the military gear that Holmes supposedly used during the attack were delivered not to Holmes' apartment (which he had just recently moved into) but in fact they were delivered to the Anschutz Medical Campus where Holmes went to school and worked. Also, Anschutz just happens to be in direct competition with Century 16 theaters in Aurora since his company owns Regal Cinemas. also, since we are on the subject, most of the incriminating information coming out of the "official" investigation seems to originate with the medical campus itself and of course, none of it can be verified since the judge issued the gag order and sealed the evidence in the case. As if that wasn't damning enough, consider this… the latest in the Holmes case involves a letter than was supposedly sent by a victim of the shooting which purports to claim that a vast "Illuminati" conspiracy is behind the event and that the victim is not really a victim of the Century 16 shooting, but rather he/she was shot by the Aurora police chief, Dan Oates and Dist. Atty. Carol Chambers in order to frame Holmes. The letter also goes on to suggest some if not all of the victims are fake (actors) and that Philip Anschutz and his corporation are partially behind it all. Where did the story first make it's way to the public? It's about as simple as a phone call or a 10 minute ride in a car. And let's face it, whomever wrote that and sent it, would NEVER have simply done so without going WAY public at the same time or before because, OBVIOUSLY… if the police chief shot them once…. So, why fabricate a letter which would be so easy to discredit immediately? Who would do such a thing and include in it such inflammatory statements that the police and prosecutors are teaming up to frame Holmes and faking victims who are actually prostitutes and even shooting people themselves? Who would write such a ridiculous letter and send it to the courts?And why would they include the statement "James is being framed by Phillip Anschutz, police chief Dan Oates, and the illuminati (sic)"? The key to understanding who wrote the letter is looking at how it was handled. When the judge released it, he released key evidence in a new crime in and of itself. He tipped off the culprit who is now probably in Dubai or somewhere non-extradition. Correct me if I am wrong, but wouldn't releasing this fraudulent motion constitute a crime in itself? Does it make the judge an accessory after the fact? Does it provide aid and comfort (and a head start) to the criminal? Should releasing this document disqualify the judge from sitting on this case? All good questions. The motion, made public yesterday and on view below, deals with claims allegedly (but not actually) made by a victim pointing the finger of blame at Aurora Police Chief Dan Oates and the Illuminati. The filing, submitted on August 27, redacts the name of the person who supposedly submitted it -- but the text suggests that the moniker appears in the official charging document, which lists 116 counts of attempted murder. Moreover, the victim whose identity was appropriated is female, as indicated in an order by Judge William Sylvester that responds to the motion; it's on view below as well. A footnote reads, "The District Attorney's Office has informed the Court that the victim indicated in this Motion informed an investigator that she did not file it." The text of the "Motion to Intervene" asks the court to take action in the James Holmes criminal case based on "newly discovered withheld evidence," as well as the author's eagerness to "speak out about the truth that i believe in my heart that James Holmes is innocent" and should be released immediately. Carol Chambers speaks to the media after a previous hearing. Why? Because, the document continues, "James is being framed by [Denver billionaire] Philip Anschutz, police chief Dan Oates, and the illuminati." Also name-checked is 18th Judicial District DA Carol Chambers, who is supposedly forcing the filer to testify as a victim against her will. "I am not a victim" of James Holmes, the author continues, because "he never shot me." So...what happened? "District Attorney Carol Chambers & Police chief Dan Oates came to my house and told me they are going to arrest me for online prostitution and escort services and charity fraud," the narrative continues, "and to make a deal with them to pretend I was a victim in this case. Dan Oates then shot me, told me in places [sic] that were not life threatening." The writer then insists that "I don't want to lie under oath and pretend I'm a victim when i'm not and have my testimony contribute to James being convicted. I can't live with that." After alleging that another person whose name has been redacted "is not a victim either," the motion concludes with the following: "This case must be looked at by the F.B.I., Arapahoe county is corrupt. Free James Holmes! Other suppose [sic] victims in this case are govt actors. They all must take polygraph tests. Please donate to my charity, the proceeds will go to James for commissary and to get him real attorneys. I demand congress get involved too!" How did Judge Sylvester respond to this twisted jeremiad? With concern. The "Order Re: Motion to Intervene" begins by noting that "the Court has information that the named victim...did not file this pleading, and it appears that someone may be filing pleadings with false names." Hence, Sylvester goes on, the motion doesn't require a ruling because it's illegitimate -- but "this Court has concerns about the mental health of the individual filing these pleadings. As such, the Court ORDERS that a copy of the Motion to Intervene and this Order be forwarded to the Arapahoe County Sheriff's Office for an appropriate investigation." In addition, a copy is also directed to the Arapahoe County Department of Human Services Adult Protection Services unit "for potential referral to an appropriate mental health agency." Sylvester also directed that the documents be made public -- a move that invites speculation about his reasoning. One possibility: He's upset that he had to waste his time with such a matter and wants to alert staffers to the possibility of more bogus filings in a case that could go on for a long, long time. (AP) Seeking to avoid any delays in the Colorado movie theater shooting case, prosecutors gave up their fight to see a notebook the suspect sent to a university psychiatrist and instead argued for a palm print to compare with one found on the inside of a theater exit door. James Holmes appeared in court Thursday with short brown hair instead of a wild shock of orangish-red hair and seemed more animated than he has been in the past. He smiled and glanced around the courtroom, looking at his lawyers and reporters covering the hearing. He appeared to be moving his mouth but not actually talking. Family members receiving updates about Holmes from the courtroom said it's all an act by the former University of Colorado, Denver, neuroscience graduate student to appear mentally ill. "He's just putting on a show," said Greg Medek of Aurora, whose daughter Micayla, 23, died in the shooting. "I don't think he's crazy. He's just evil." Jessica Watts, whose cousin Jonathan Blunk, 26, died in the shooting was in the courtroom and provided the update to Medek. "I don't want them rushing anything," Watts said. "I know they're (prosecutors) going to fight for this case." Holmes faces 152 charges in the July 20 shooting that killed 12 people and wounded 58 others. Holmes has not entered a plea and won't do so until after a preliminary hearing, where prosecutors are to present evidence supporting the charges. That hearing is currently scheduled to begin Nov. 13. Holmes' mental health played a role in the prosecutors' decision to drop their pursuit of the notebook, which purportedly contains violent descriptions of an attack. Deputy District Attorney Rich Orman said it's likely that prosecutors would gain access to the notebook, now in the custody of the court, should Holmes' mental health become an issue. Defendants who plead not guilty by reason of insanity give up some patient-doctor privacy protections. Orman said he didn't want to delay the case by the appeals that were expected to follow any decision by Arapahoe County District Court Judge William B. Sylvester over access to the notebook. "We still think we have good and compelling evidence that the notebook should not be privileged," Orman said, adding that because of possible delays, "we're not asking to look at it." Prosecutors argued for Holmes to submit a palm print in order to compare it with one found at the scene. Orman said that standard fingerprints could not be used to compare the print found at the theater. Defense attorney Daniel King objected on the grounds that Holmes had already been fingerprinted and being forced to submit an additional print is unreasonable. Sylvester did not immediately rule on the prosecution's request. Defense attorneys say Holmes is mentally ill and that the notebook, sent to Dr. Lynne Fenton, shouldn't be released because of doctor-patient privilege. Prosecutors have argued that the notebook sent in the hours before the shooting and its contents are fair game. Holmes planned to be dead or in prison after the shooting rampage at a special midnight showing of "The Dark Knight Rises," they said, and he had no plans to undergo therapy. Fenton last saw Holmes professionally on June 11 before seeing him again in court on Aug. 30. Former Denver prosecutor Karen Steinhauser said prosecutors want the notebook to bolster their case that the shooting was deliberately planned and carried out by a sane person. But should Holmes plead insanity, prosecutors would have the right to materials, including the notebook, which the examining psychiatrist would have used to form a professional opinion about Holmes' sanity. If Holmes is considered mentally ill, but competent to stand trial, the notebook could remain off limits to the prosecution. Steinhauser also said prosecutors might be able to gain access to the notebook through an "implied waiver" of privilege should Holmes talk about its contents to inmates or jail guards. "They (prosecutors) believe they will ultimately have access to that notebook," said Steinhauser, who is also a law professor at the University of Denver. "They want to keep this case moving." Holmes has not entered a plea and won't do so until after a preliminary hearing, where prosecutors are to present evidence supporting the charges.
