Interesting to see the debate move into a mainstream arena. But I think his last sentence says it all. That there are some whose fortunes (and raison d'etre) are made on this being illegal is a powerful incentive to keep it that way and what will they do for social control if they don't have victimless crime laws? Good god, we can't be putting bankers stealing pensioners and a nations life saving in jail. They're respectable members of the community.
