GOP Judge Gains 7,500 Votes in Wisconsin Election after "Inputting Error"

WAUKESHA - Incumbent Justice David Prosser gained a 7,500-vote lead in the hotly contested state Supreme Court race Thursday after the clerk in conservative-leaning Waukesha County announced she undercounted the votes because of an inputting error.

If the new results stand, they would swing the election to Prosser after unofficial results Wednesday showed challenger JoAnne Kloppenburg was the winner with a 204-vote lead out of nearly 1.5 million votes cast.

The new totals showed Prosser with 92,263 votes in Waukesha County, while Kloppenburg had 32,758. County totals previously showed Prosser with 81,255 votes and Kloppenburg with 29,332.

Waukesha County Clerk Kathy Nickolaus said the votes from the city of Brookfield weren't reported to The Associated Press on Tuesday because of "human error."
"This is not a case of extra votes or extra ballots being found," she said. "This is human error, which I apologize for." She added that human error "is common in this process."

The missing numbers were all from Brookfield, said Nickolaus, who said she discovered the error Wednesday. Apparently, she said, she entered the numbers into the system and failed to hit "save."
Nickolaus said when she came in to upload the information for the statewide canvass, she noticed all of the fields and columns for the city of Brookfield results were blank.
She said the mistake occurred on the "day-to-day system" she uses in her office and had "nothing to do with the election software or system at all."

Confidence is high'

Before the announcement, it was assumed the race between Prosser, a 68-year-old conservative justice, and Kloppenburg, a liberal assistant state attorney general, was headed for a recount. But Prosser's lead is likely to stand if the new numbers hold up through canvassing in all of Wisconsin's 72 counties.
Prosser said Thursday night he was "encouraged" by the reports from county canvasses.

"Our confidence is high, and we will continue to monitor with optimism, and believe that the positive results will hold," Prosser said in a statement. "We've always maintained faith in the voters and trust the election officials involved in the canvassing will reaffirm the lead we've taken."
Opponents of the collective bargaining law hoped a Kloppenburg victory would set the stage for the high court to strike it down.

Open records request

Thursday night, Kloppenburg's campaign manager demanded a full explanation of how the error occurred.
Melissa Mulliken said an open records request for all relevant documents will be filed.
The count was corrected on the first day that counties were in the process of verifying unofficial vote totals reported Tuesday. The race was so close, despite 1.5 million votes being cast, that the lead flipped back and forth repeatedly on election day and in the days after as those preliminary totals were checked and updated.

Gov. Scott Walker said before details of the new votes were announced that voters will demand transparency.
"The overriding principle has got to be that every vote that was legally cast in Wisconsin needs to be counted," Walker said.
The discovery of votes that could give Prosser the win and quash any recount before it starts had liberal groups crying foul.

"There is a history of secrecy and partisanship surrounding the Waukesha County clerk and there remain unanswered questions," said Scot Ross, director of the liberal group One Wisconsin Now.

He added, "Her computers need to be seized and a forensic expert needs to go through them as if a crime could have occurred."

And Citizen Action of Wisconsin called for a federal investigation into the situation.
The state Government Accountability Board, which is in charge of overseeing Wisconsin's elections, will review Waukesha County's numbers to verify the totals, said agency director Kevin Kennedy.

"We will conduct our own review of issues because we want to make sure that we are tracking every entry she made into our system," Kennedy said.
Kennedy said it was unfortunate the clerk didn't double-check the data before releasing it to the press.

"Mistakes are never simple, they usually compound themselves, but these are the kind of mistakes we see happen, we just don't see them of this magnitude," Kennedy said.

History of controversy

Nickolaus has come under scrutiny before.
Last year, county officials raised objections to her practice of storing election data off the county's computer network, instead keeping it on computers in her office, the Milwaukee Journal Sentinel reported.

The practice, which Nickolaus said was aimed at keeping the data more secure, prevented the county's information technology specialists from verifying the system was fail-safe, the county's director of administration said at the time. Auditors later recommended Nickolaus improve security and backup procedures.

In 2001, Nickolaus was granted immunity to testify about her role as a computer analyst for the Assembly Republican Caucus, then under investigation - along with the Senate Republican Caucus and the Democratic caucuses for both houses - for using state resources to secretly run campaigns.

Nickolaus, who worked for seven years as a data analyst and computer specialist for the Assembly Republican caucus, headed up an effort to develop a computer program that averaged the performance of Republicans in statewide races by ward.
During some of that time, Prosser served as Assembly Speaker, meaning he was essentially her boss.

Prosser, who was speaker of the Assembly in 1995 and 1996 and controlled the Republican caucus, was not part of the investigation.
Nickolaus resigned from her state job in 2002 shortly before launching her county clerk campaign.

"This raises so many questions," said Assembly Minority Leader Peter Barca, D-Kenosha.
Barca said he was shocked Nickolaus waited 24 hours to tell people about the error.
A Democratic canvass observer said Nickolaus gave no indication anything was unusual when she arrived at about 9 a.m. Thursday morning, and she didn't find out about the error until the news conference that evening.
"There was no mention of Brookfield," volunteer canvass observer Nora Wilson said.

There is no good spin on this. She is either negligent and clueless or there is dark arts at work. The latter more likely given her recent form and that of the Republicans generally. The whole election should be voided and done again with paper ballots only. :fullofit:

Kathy Nickolaus admitted she's lying during her press conference. She and others who aren't very technically savvy just haven't realized it yet.
But before we get in to that lets get some history….
Until a couple months ago lets face it… Wisconsin wasn't even a thought in most of our minds. But then came new Republican Gov. Scott Walker and his plan to end Unions in the state. That move and the crazy tactics that followed it put Wisconsin on the political map and brought the Republican plan to destroy the American union to the common man's attention.
These moves produced a horrible taste in the mouths of typically conservative voters when it came to the Republican party in their state. The first signs of this were seen recently in their State Supreme Court election which was just held this past week. In that election 19 counties in that state who went Republican for Scott Walker last November FLIPPED and went for the Democrat in this race.
If that wasn't shocking enough what really should strike you is how this Democrat JoAnne Kloppenburg who before was an unknown came back to beat the incumbent GOP Justice David Prosser!
Or so we thought….
This brings us to yesterday when, Waukesha County Clerk Kathy Nickolaus held a press conference to state that she had not included 10k+ votes in her initial election night tallys. Furthermore, the new count which includes an entire city Nickolaus "mistakenly" failed to count just happends to hold 7k+ votes for the GOP Justice Prosser swinging the election back to him in a big way.
Now, right out of the gate this situation sounds fishy. If you dig (not very deep) in to Kathy Nickolaus you will see a history of shady political connections and actions that makes the story ever more fishy. But, you know the truth is mistakes happen, human error happens and her questionable past and questionable timing aren't the red herring that proves her dishonesty (at this time).
What does PROVE Nickolaus' dishonesty is this statement during the press conference regarding the newly found votes:
"this is an access database file that was on our regular system and it was just a matter of the save and it was just human error." (see video below this statement appears at about 4:28 in to the video)
The two things that jumped out to me in that statement are the words "Access Database" and "Save". Because you don't hit "Save" when working in an Access Database. The second you type anything in to a field in Access it is saved. Typically you couldn't even find a save button in an Access DB if you wanted to!
Is it possible that her database was designed in such a way where she has to hit save? Yes. But it is highly, highly unlikely and would require a programmer to go out of his/her way to implement such a thing as it is so contrary to the way Access works.
I have worked in IT for over 16 years now. I have been an Access developer just as long. I have built countless custom Access Databases for a variety of businesses and Government Agencies. I have supported countless other existing Access databases including one which runs the County Board of Elections in an Upstate NY county. NONE of them require you save when you enter, import or change data.
If she had said she was working with a spreadsheet or word document or anything other than Access her lie would be believable. But when you stand up and say this error was caused by "human error" and not saving data in Access I call Shenanigans immediately.
We should not let these corrupt Rethug lies stand. I feel like we are back in Florida in 2000 all over again…. and we all know how that turned out.

BIG UPDATE!!
In this 2006 election, Van Hollen won the election for Attorney General with these numbers:
1,065,453 - Van Hollen ®
1,056,594 - Falk (D)
A difference of 8,859 votes STATEWIDE.
Waukesha county, Kathy Nickolaus' playground, reports 17,243 more votes cast for the Attorney General race in Waukesha county than there were total number of ballots cast.
How many more of those "extra" 17,243 votes were for Van Hollen than were for Kathleen Falk?? I'm guessing it's somewhere right about 8,900 votes Tongue
Since that election, Van Hollen has become infamous for forging the WI Secretary of State's name on the appeal of the TRO against the WI anti-union bill and then getting fired as the SoS' legal representation as a result. He's Walker's man, through and through.


TUESDAY UPDATE:
Apparently this diary came to the attention of Kathy Nickolaus, and she issued a statement about the discrepancy.
Asked about the blog report, she told the Journal Sentinel via email: "The answer to your question is that the number of ballots cast on the summary report will not equal the number of votes cast. It only reflects the votes reported electronically to the office. I have added an asterisk with this clarification to the webpage."

So now, the Waukesha County election website listings look like this:

Notice that they've added this to the top of the page:

And there are 8 elections with asterisks now, all coincidentally elections that Kathy Nickolaus was in charge of (and none before she took over).
If you review the election for Waukesha county for the 2004 Presidential election, the number of ballots listed is 231,031 and the numbers of total votes recorded for President is 230,363, no discrepancy. It's not until Kathy Nickolaus lands on her feet in Waukesha county as the county clerk (after the Caucus Scandal where she sang like a bird when granted immunity) that these discrepancies started occuring.
We need the DOJ to investigate, and we need them to grant her immunity (imho). We need to uncover the full depth of this corruption. And give her Witness Protection too, we don't want her to end up Michael Connell'd.
