Fort Hood Shooting Suspect's Trial On Hold Over Beard

FORT HOOD, Texas -- For the past two months, the military judge presiding over the high-profile case of the Army psychiatrist charged in the deadly 2009 Fort Hood shooting rampage has said he wanted to avoid disruptions in court.

So after Maj. Nidal Hasan showed up for a June pretrial hearing wearing a beard, a violation of Army regulations, Col. Gregory Gross banned him from the courtroom until he shaves.

Now Hasan's facial hair has become a bigger disruption than anyone might have foreseen. All hearings and the murder trial, set to start next week, were put on hold Wednesday while an appeals court considers Hasan's objections to being forcibly shaved.

The delay is frustrating for many involved in the case, although some victims' relatives say they have grown accustomed to waiting for the trial to start. It's been almost three years since the shooting rampage left 13 dead and more than two dozen wounded on the Texas Army post.

"I stopped holding my breath a long time ago as far as expecting to get any closure regarding the trial," said Leila Hunt Willingham, whose brother Jason Dean "J.D." Hunt was among those killed Nov. 5, 2009.

Gross has not allowed Hasan to stay in the courtroom, saying the beard is a disruption. However, in late July Gross said he wanted Hasan in the room during the court-martial to prevent a possible appeal on the issue if he is convicted. He said Hasan would be forcibly shaved before the trial if he didn't shave the beard himself.

Hasan, an American-born Muslim, won't shave because the beard is an expression of his faith, defense attorneys have said. Hasan also has had a premonition that his death is imminent, his attorneys said.

"He does not wish to die without a beard as he believes not having a beard is a sin," one of Hasan's attorneys wrote in his appeal to the U.S. Court of Appeals for the Armed Forces.

Hasan faces the death penalty or life in prison without parole if convicted. No military death-row inmates have been executed since 1961.


Prosecutors have said Hasan grew the beard so trial witnesses would have a hard time identifying him. They have said they doubt religion is his motive, noting he was clean-shaven at the time of the shootings.

Gross told defense attorneys at a June hearing that he disagreed with their argument that Hasan's beard didn't take away from the dignity of the proceedings.

"This is a choice that Major Hasan is making," Gross said at a June hearing.

At the start of Wednesday's hearing, Gross once again found Hasan in contempt of court and fined him $1,000 for disobeying orders to shave. Hasan then was taken to a nearby room to watch the proceedings on a closed-circuit television.

Hasan had been scheduled to enter a plea Wednesday, but the court proceedings were put on hold before he could do that.

Hasan indicated he wanted to plead guilty for religious reasons, according to a defense motion. But in ruling on the motion, Gross said he would not be able to accept a guilty plea on the 13 charges of premeditated murder because the charges carry a possible death penalty, which the government is pursuing the death penalty in Hasan's case.

Hasan, 41, also is charged with 32 counts of attempted premeditated murder.

The court-martial, scheduled to start Monday with jury selection, will be on hold until the appeals court rules on Hasan's appeal to the judge's order to being shaved. Wednesday's court order that halted the proceedings gives the judge a week to respond.

Some military law experts not involved in the case said this seems to be a defense strategy.

"The defense is trying everything to delay this case, and it's frustrating that the beard issue has gone this far," said Jeffrey Addicott, a retired military attorney who is now director of the Center for Terrorism Law at St. Mary's University School of Law.

Their priorities are always interesting. Like how the Vatican moved at the speed of light and left no stone unturned to find out who was leaking information to but rape a child and you just get moved on to another parish while the child is told they will go to hell. The beard must be shaved because not to do so shows insubordination and personal will in the corporate straight jacket that is the military and the suspect must be shown who is in charge here. And it wont be him. If he is allowed to get away with such individualism and such a 'fuck you' to they military it will be end of the world as they know it.

Might set a legal precedent...and force the Batman Shooter to keep his red-orange hair through trial...following same illogic [that the witnesses won't otherwise be able to 'recognize' him - even though NO person SAW the Batman shooter - and many said there were more than one shooter at Ft. Hood. Good Show! Good Circus!].

I say a compromise....half a beard on one side of the face only. Or a Castro-look-alike in the dock in his place, might work.....

A former US Army psychiatrist who killed 13 soldiers at a base in Texas in 2009 has admitted in court he was the gunman and apologised for "any mistakes", as his court martial opened.
But Maj Nidal Hasan told the jury at Fort Hood, Texas, that the evidence told only one side of the story.
The 42-year-old says he was protecting Muslims and the Taliban in Afghanistan.
If convicted on 13 counts of murder and 32 counts of attempted murder, the US-born Muslim could face execution.
"The evidence will clearly show that I am the shooter," Maj Hasan, who is acting as his own lawyer, told the jury of 13 military officers as the trial began on Tuesday.
"We are imperfect Muslims trying to establish the perfect religion," added the accused, who uses a wheelchair after being paralysed when he was shot during the attack.
He declined to cross-examine any of the witnesses wounded in the assault.
'Careful preparations' The killings on 5 November 2009 are the deadliest ever non-combat attack on an American military base.
During the prosecution's opening statements, Col Steve Henricks said Maj Hasan had deliberately targeted "unarmed, unsuspecting and defenceless soldiers" when he opened fire, and planned to "kill as many soldiers as he could".


The BBC's Nick Bryant says the court "looks more like a bunker"

He said the accused had prepared carefully for the attack, visiting a target practice range, buying a gun, and stuffing paper towels into his trouser pockets to muffle noise from the weapons before he opened fire.
"All those fully loaded magazines do not clink, do not move, do not give him away," Col Henricks told the jury. "He sits among the soldiers he's about to kill with his head down."
The court heard that Maj Hasan had first tried to clear the area of civilians, even walking over to a clerk to tell her a supervisor needed her elsewhere in the building.
He then climbed on to a desk, shouted an Islamic benediction, and opened fire with two handguns, witnesses said.
'Dead men don't sweat' According to the prosecution, he fired 146 bullets.

The attack took place in a crowded medical building where deploying soldiers were awaiting check-ups and vaccines.
Staff Sgt Alonzo Lunsford, who was shot seven times during the attack, testified how he had played dead.
Then he worried that the gunman might notice he was perspiring, as "dead men don't sweat".
Sgt Lunsford said he decided to flee and found an exit crammed with other soldiers trying to make their escape, too.
Maj Hasan was himself about to be deployed to Afghanistan at the time of the assault.
But the court heard that he had told a base doctor: "They've got another thing coming if they think they are going to deploy me."
The government has said Maj Hasan sent more than a dozen emails starting in December 2008 to Anwar al-Awlaki, a radical US-born Islamic cleric killed by a drone strike in Yemen in 2011.
Maj Hasan wanted to plead guilty to murder and attempted murder, but military rules forbid guilty pleas in death-penalty cases.
There is outrage in the US that he is still receiving his salary.
He has reportedly received wages totalling nearly $300,000 (£200,000) while awaiting trial.
