Police Warned A Month Before Colorado Movie Theater Attack That Holmes Was A Public Danger

Records show Colorado university psychiatrist warned police a month before July mass shooting that suspect had homicidal thoughts and was a public danger.
A University of Colorado psychiatrist told campus police a month before the Aurora movie theater attack that James Holmes had homicidal thoughts and was a public danger, according to records unsealed Thursday.
Lynne Fenton, a psychiatrist at the Denver campus, told police that Holmes had also "threatened and harassed her via email/text messages" in June 2012. He is standing trial for the July 20 shooting rampage that killed 12 and injured 70 during a midnight premiere of the latest Batman movie.
Campus police would not comment, and a university spokeswoman did not immediately respond, the Associated Press said.
Soon after the shooting, university police said they had not had any contact with Holmes, a graduate student doing neuroscience research. But a search warrant affidavit released Thursday revealed that an officer had told investigators that Fenton had contacted her to report "his danger to the public due to homicidal statements he had made."

If true, the Police are going to be charged with Gross Negligence, if not worse and may have been involved in a LIHOP!....I still have a gut feeling someone was tampering with his mind at that point....who? why? That's why they want him charged with 1st degree murder not insane manslaughter...so he can be kept locked up and never talk to investigative journalists/researchers etc. The evidence of the event itself still, as far as I can tell, doesn't fit one person - nor the stated facts of the Police. I suspect this was a provocation - one of so many to keep the terror level on RED!

'Gunmen' Hired to Storm Movie Theater for Traumatizing Publicity Stunt

The promote its premiere of the new Iron Man movie, a theater in Jefferson City, Missouri, hired several people to dress in full tactical gear and storm the screening with fake weapons drawn.
Not surprisingly, some people were not too keen on the "publicity stunt.""We're just getting into the car when I spotted a man in full assault gear, carrying what appeared to be a modified M-4 and 9 mm on his side," said John Molock, an army war vet who says the experience triggered his PTSD.In addition to stoking the ire of theatergoers, the stunt also garnered poor reviews from the local police department which was forced to field several nervous 911 calls."We received a series of 911 calls stating that a man dressed in all black and body armor and a rifle was walking into Capital 8 Theaters," Capt. Doug Shoemaker told the local Fox affiliate.


"Everything was in place, it's the opening night of a superhero movie, it's somebody walking in all-dark clothes, everything pointed to bad things about to happen," Shoemaker added, referencing the Aurora movie theater shooting that took place last July. "There's really no good that can come of this."
But Capital 8 Theaters manager Bob Wilkins remains defiant, telling the ABC affiliate that he did not regret pulling the stunt, which he said was planned months in advance.
"My job is to entertain people," Wilkins said, claiming only "a few" patrons were upset.
Shoemaker noted that angry customers would have been the least of Wilkins' worries if someone with a concealed weapon would have mistaken the stunt for an active shooter event and acted in self-defense.

Lucky they didm;t dress them in civvies, as else the result could have been an invasion of all the ABC agencies, the military, Homeland Security and a private security company etc., along with a full blown lockdown of Jefferson City -- followed by conflicting stories of who shot whom, who got arrested alive but is later found riddled with bullets and dead, or arrested alive and then stabbed in the throat - people run over but not... and so on and so forth.

Well I will not pretend to know how this works in CO or in a case of this magnatude. Insanity pleas are rare and often do not work.
I actually had one a few years ago. My client had gone into the home of a cop and took a bath, made some calls, went outback to try to dig up her dead baby.
She truly was insane at the time she entered the home. She lacked any intent to commit a crime.
Part one of the defense was to have her examined for competency to stand trial. She was found not competent.
Then she was sent off to a hospital and put on meds. Eventually she regained her competency.
Then she was re-examined for insanity at the time of the event. The doctor agreed that she had not been sane.
It took a lot of work but I got the case dismissed. (Never had to have a trial). JUst had to prove to the elected DA that she was in a safe enviornment, on her meds, etc.

Then there was the trial of the mom in TX who drowned all her kids. Initally she was found guilty.
But the DA presented evidence that was false, stating she had gotten the idea from a Law and Order episode.
However that episode was shown after her trial. So her conviction was overturned and the case was remanded back to have a second trial.
That case proceeded to trial and her attorney was able to convince the jurors that she had been insane at the time, and she was committed to a state hospital.
I suspect that the process of the TX mom will be similar to that of the defendant in CO. That an attorney will have to convince a jury that the man did not know that his conduct was wrong.
I suspect also that this will be one very tough sell. Most insanity defenses fail.

What is the truth of her supposed warning to Officer Whitten thirty-eight days prior to the shooting.

Obviously Holmes was building to the event as was Sirhan. Are we seeing another model psychosis caused by methamphetamine or microwave.

Is it not one more ironic inside joke that CIA's Helms initially appointed John Moss Whitten to investigate that other lone nut's handiwork.

I agree that Lynn Fenton is the key here. What was the nature of her alleged "warning"? What was Holmes telling her in their sessions?
But she is not talking. I imagine she will assert dr. client privilege at trial. She had a duty to warn under the Tarasoff exception to dr. client
confidentiality. If your client tells you in session that he or she plans harm to another the Dr MUST report. It's an old Supreme Court case.
However if she was involved in creating his conduct that will never be admitted.
