U.S. District Judge Susan Oki Mollway signed the order dismissing the case against Mordechai Orian, owner of Global Horizons Inc., and four co-defendants after federal prosecutors said they are unable to prove their case beyond a reasonable doubt.
Three other defendants who have already pleaded guilty will get the opportunity to withdraw their pleas.
The request for the dismissal was signed by U.S. Department of Justice Civil Rights Division attorney Daniel H. Weiss.
The dismissal comes 11 months after the government dropped a similar case against brothers Alec and Mike Sou of Aloun Farms in the middle of trial.
The Global Horizons case had been scheduled for trial next month.
