All charges against Cyril Wecht have been dropped

It has been a long ordeal for my friend Cyril Wecht, but I am so happy that it is finally over. This is a case that should never have been allowed to go to trial. This was prosecutorial and judicial misconduct at its worst. The fact that Mary Beth Buchanan continues to assert that a crime was committed just underscores what a disgrace to the bar she is. Dozens of prominent members of the bar have decried this prosecution including Richard Thornburg, a Republican and a former Pa. Governor and U.S. Attorney General. The Chairman of the House Judiciary Committee John Conyers attempted to investigate why the case was brought and met with a total refusal by Buchanan to cooperate. If you did not know it, Buchanan was a trusted lieutenant to former Attorney General Roberto Gonzales, spending much of her time in Washington helping Gonzales determine, among other things, which U.S. Attorneys to fire. She is infamous as one of those U.S. Attorneys who only managed to indict Democrats.

I am convinced that this prosecution was hatched in Washington, and I will probably write about it because people deserve to know why Cyril was subjected to this charade of an indictment.

U.S. Attorney Mary Beth Buchanan announced at a Tuesday morning press conference that her office is dropping prosecution of former Allegheny County Coroner Cyril Wecht.

U.S. Attorney Mary Beth Buchanan this morning filed a motion to dismiss all of the charges against former Allegheny County Coroner Dr. Cyril H. Wecht.

In a news conference, the prosecutor said that a ruling by U.S. District Judge Sean J. McLaughlin last month suppressing crucial evidence in the case severely hampered any chance her office would have to move forward.

Though the charges filed against Dr. Wecht more than three years ago have been dismissed, Ms. Buchanan said she still believes that a crime was committed.

"However, in our society everyone is innocent until proven guilty," she said. "As we stand here today, he's still innocent.

"If I could have a do-over, I'd still bring the case."

Judge McLaughlin found in a 55-page opinion that search warrants filed in the case were too general. Specifically, the warrants related to boxes of private autopsy files that were found in Dr. Wecht's private offices, as well as a laptop computer used by his administrative assistant. Both were found to be deficient.

The judge wrote in his opinion that had a supporting affidavit of probable cause been attached to the warrant applications, the problem would have been resolved.

Ms. Buchanan admitted that a mistake was made by not attaching the paperwork, but she continued, it was left out so as not to reveal too much information about the ongoing investigation.

"This is something I doubt will ever happen again in the Western District of Pennsylvania."

Dr. Wecht was indicted in January 2006 on charges that he misused his public office for private gain. His trial ended in a hung jury last year.

Jerry certainly wrote what I would have had I heard the news first. Cryil is also a friend of mine and I've had a trickle of private exchange of emails with him during this ordeal. He stood-up bravely, but he and his family were subjected to more damage than can ever truely be set right - despite his vindication at this late date. When I read this wonderful news, I also realized how few things we post that are good news items. This is one!....even if the good news that one piece of bad news is now over - such are the times we live in. Now, why don't they prosecute Buchanan!

Excellent news Peter. I hope he and his family are left in peace now though I know it has caused much damage. It reeks of political persecution. I wonder if they will return all of the files now.

Well, it was Adele who notified us, not me. I don't know the details, but understand that emotionally and financially much damage has been done. His legal fees have been extreme. They can destroy you just by attacking you and forcing you to defend youself. I certainly don't know, but assume all the files will be returned - and well looked over while they were away.....:marchmellow::marchmellow:

Jerry Policoff will be looking into this matter further. In addition to the news about Cyril I received this email as well:

One of the tidbits I stumbled onto last year was that Mary Beth Buchanan’s attorney (or at least one of them) was one of the former Justice Department lawyers implicated in the leaking the name “Steven J. Hatfill” to the news media as a “person of interest” in the Anthrax investigation. That was a bogus Justice ‘Department operation that appears to have been orchestrated directly by then Attorney General John Ashcroft. I don’t know what the relevance, if any, of one of those leakers later becoming a lawyer for Buchanan, but I think it hints at her friends in high places in the Bush Justice Department.

Well, definitely want to hear more on that, when it comes down the pike. That would indeed speak of very 'interesting' connections to the heart of the Beast.....wouldn't surprise me, but I'll withhold a conclusion until I see the evidence. That would in an interesting roundabout way also bring Dallas closer to 911 (through wormholes in spacetime). Buchanan has already proven herself to be in the Right's 'ends justify the means' crowd - and I don't like their 'ends' one bit, either.

That was an interesting bit in Jerry Policoff's note about the Hatfill accusation and Ashcroft's involvement, all suggesting that the anthrax letters and poisonings were US government-initiated, as we already know from the high-grade weaponized anthrax spores from Ames, Iowa, and Fort Detrick, etc.

It's just like the 9/11 attacks. The patsies in that case were Osama bin Laden and Al Quaeda. Has anyone noticed if Osama bin Laden has ever been put on the FBI's Wanted Poster for the 9/11 attacks? He was never put on it because the FBI did not have the evidence, yet the propaganda given to us still resonates with many people who believe Osama was responsible for 9/11.

A new Newsweek poll out this weekend exposed "gaps" in America's knowledge of history and current events.

Perhaps most alarmingly, 41% of Americans answered 'Yes' to the question "Do you think Saddam Hussein’s regime in Iraq was directly involved in planning, financing, or carrying out the terrorist attacks of September 11th, 2001?"

That total is actually up 5 points since September 2004.

Further, a majority of people couldn't identify Saudia Arabia as the country of origin of most of the 9/11 hijackers, even given the question in multiple choice format. 20% answered Iraq, while 14% believed the hijackers came from Iran.

A majority (52%) believe the US is losing the war against al Qaeda, however Newsweek disagrees. In the magazine's reporting of the poll, they made judgment that the US is in fact not "losing the fight against al-Qaeda or radical Islamic terrorism."

Closer to home, 89% of Americans are unable to name the Chief Justice of the Supreme Court (John Roberts), though a majority of those polled were able to name Nancy Pelosi as the current Speaker of the House.

A large majority of people said they didn't know or didn't care who the winner of this year's American Idol competition was (or at least weren't willing to admit it).
